Information on the Right of Withdrawal and Legal Warranty
(Information pursuant to the Italian Consumer Code – Legislative Decree no. 206 of September 6, 2005, and subsequent amendments, supplemented by Legislative Decree no. 209 of December 31, 2025, implementing EU Directive 2023/2673).
1. The Supplier The supplier of the requested products is Simatshop sas di Vaglio Antonella, with registered office at via I Maggio, 120 - 10040 Rivalta di Torino (TO) - Italy.
2. Exercise of the Right of Withdrawal (Cooling-off Period) Pursuant to Art. 52 et seq. of the Italian Consumer Code, the consumer has a period of 14 calendar days (starting from the day physical possession of the goods is acquired) to withdraw from the contract without providing any reason.
In accordance with the new Article 54-bis of the Consumer Code (introduced by Legislative Decree no. 209/2025), this website provides a direct digital function (electronic withdrawal link/button located in the website footer) for immediate submission of the request. Pursuant to the same article, following electronic submission, an automatic acknowledgment of receipt will be sent to the consumer on a durable medium (e-mail) specifying the date and time of receipt.
3. Exclusions from the Right of Withdrawal Pursuant to Art. 59 of the Consumer Code, the right of withdrawal is strictly excluded for:

Customers purchasing with a VAT number (Partita IVA) and requesting a commercial invoice (as they do not qualify as "consumers" under current regulations).

The supply of goods made to measure or clearly personalized (Art. 59, let. c).

The supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery (Art. 59, let. e). By virtue of this provision, by way of example but not limitation, the right of withdrawal is completely voided if the following items are opened, unsealed, or used:

Liquids and chemical consumer products (e.g., bottles of maintenance liquids such as Aqua Kem, additives, or detergents whose packaging/cap has been opened or whose warranty seal has been removed).

Sanitary and personal hygiene items (e.g., toilet paper for motorhomes/boating, portable toilet or bidet seats, chemical and traditional toilets, sanitary fixtures, and related accessories) if they are stripped of their transparent protective film, original factory-sealed packaging, or if they have been even minimally installed or put into operation.

4. Conditions of Integrity and Forfeiture The right of withdrawal is completely voided if the essential condition of the product's integrity is compromised, as provided for by Art. 57, paragraph 2 of the Consumer Code. The withdrawal will not be approved in the event of:

Partial or full use of the product or any related consumer materials.

Missing external packaging and/or original internal packaging.

Absence of integral elements of the product (accessories, cables, manuals, parts).

Damage to the product due to causes other than its transport from the seller to the consumer.

Missing sales document or attached tax receipt.
If the right of withdrawal has forfeited for the reasons stated above, Simatshop sas will return the purchased item to the sender, charging the customer for the relevant shipping costs.
5. Allocation of Shipping and Return Costs Regarding the shipping costs for returning the goods, the following legal criteria apply:

WHEN SHIPPING COSTS ARE BORNE BY THE CUSTOMER (Exercise of Withdrawal / Customer Error): Pursuant to Article 57, paragraph 1 of the Consumer Code, the consumer shall bear the direct cost of returning the goods. Therefore, if the customer exercises the right of withdrawal because they changed their mind, do not like the product, or made an error during the order phase (e.g., wrong selection of model, size, variant), the return is NOT free. The return shipment must be made within 14 days of the request's approval, at the user's expense and care, using a trackable method with a carrier or courier of their choice.

WHEN THE RETURN IS FREE (Conformity Defect): The return is entirely at the expense of Simatshop exclusively in cases of conformity defects or errors in shipping the item by the merchant, as provided for by the regulations on the Legal Warranty of Conformity (Art. 128 et seq. of the Consumer Code). In these specific and verified circumstances, the transport costs for the return and replacement of the item will not be charged to the consumer.
6. Refund Pursuant to Art. 56 of the Consumer Code, SIMATSHOP will refund all payments received within 14 days from the moment it is informed of the consumer's decision to withdraw, using the same means of payment used for the initial transaction.
In any case, pursuant to the same article, the seller may withhold the refund until the goods are received back or until the consumer has supplied evidence of having sent back the goods. The refund refers to the price of the returned product, excluding additional shipping costs paid during the purchase phase. For refunds via bank transfer, the submission of IBAN details is required.
7. Legal Warranty of Conformity Products are covered by the 24-month legal warranty for conformity defects, pursuant to Art. 133 of the Consumer Code. Damage due to wear and tear or improper use is excluded.
Should the product returned under warranty prove to be fully functional or exhibit faults attributable to incorrect use by the user, all transport costs will be borne by the buyer, in addition to a technical verification fee equal to €30.

In addition to the conventional methods of declaring a withdrawal (e.g. by email, post or fax), this website also offers an electronic withdrawal function. This function ("withdrawal button") can be found in the customer area and in the footer of this website. You can use this function to withdraw from your contract online. After submitting your withdrawal, you will automatically receive an acknowledgment of receipt on a durable medium (e.g. by email).
