Any order placed for a product listed in the online store of the site (hereinafter the seller's site) presupposes consultation and preliminary acceptance of these general conditions of sale. Clicking to validate the order implies full acceptance of these. This click has the value of an "electronic signature".

These general conditions of sale are intended to define the rights and obligations of the parties in the context of the online sale of goods offered by the SELLER to the consumer.
Order Confirmation
The contractual information will be the subject of an electronic confirmation to the address indicated by the consumer in the order form.
Proof of Transaction
The computerized records, stored in the IT systems of the company THE SELLER in reasonable conditions of security are considered as proof of communication, orders and payments made by both parties.
The archive of order forms and invoices is made on a reliable and durable medium that can be used as evidence.
Product Information
All efforts have been made to ensure the accuracy of the information presented on the SELLER SITE.
THE SELLER or its suppliers are in any case not responsible for the consequences, incidents, special damage resulting from electronic transmission or the accuracy of the information transmitted even if the SELLER has been aware of the possibility of such damage. The names and brands of products and manufacturers are used only for identification purposes. The photos, descriptions and prices of the products are not contractual.
Prices
The prices of the products displayed are VAT included.
Prices can be changed at any time, without notice.
Given the variability of purchase prices at a global level, the prices of the products are considered confirmed only for the material indicated as available. The products that are not available and therefore with delivery in 10/20 days or orderable by reservation, can show the last price they had when they were available.
Delivery Methods
The products will be delivered to the address indicated by the consumer on the order form and only in the geographical areas that we serve.
All products leave our premises in perfect condition. The customer must report to the carrier the slightest trace of impact (hole, trace of crushing etc...) on the package, and if necessary refuse the package. A new identical product will then be sent back to you free of charge.
The exchange of any product declared later, spoiled in transport, without any reservation having been issued upon receipt of the package, cannot be taken into consideration.
As with any shipment, it is possible that it may be delayed or that the product may be lost. In this case, we will contact the carrier to open the necessary paperwork. We will do everything in our power to minimize the inconvenience.
We decline all responsibility regarding the extension of delivery times by the carrier, in cases of loss of products, adverse weather conditions or strikes.
Technical Information
The technical information included in our catalog is taken from the information published by the manufacturer of the items.
Therefore, we reserve the right to modify/adapt the technical information of the products in the catalog, even without prior notice.
The images relating to the items are as faithful as possible to the object that will be delivered.
Product Availability
The products that are indicated as available, therefore with a quantity other than 0, are available in our warehouses in Italy.
We have an automatic warehouse management with real-time availability.
However, a slight deviation in the quantities in stock may occur and in the event of a product shortage, we will notify you of the new delivery times.
Invoicing
A Fiscal Receipt valid for tax and warranty purposes will be sent together with the goods.
To receive the Fiscal Invoice, we ask you to fill in all the fields with your company data.
The data sent by email may not be seen before the preparation and shipping of the packages, due to the high number of emails received per day.
The invoices issued are accompanying and travel with the package.
In case you need to purchase products Outside the VAT Range, contact us by email or phone before ordering.
Withdrawal and Warranty
Information for the consumer in accordance with Legislative Decree 206 / 2005. Implementation of Directive 91/1 / EC on the protection of consumers in matters of distance contracts.
The supplier of the services or products requested is Simatshop sas di Vaglio Antonella, with registered office in Via Tanaro 45 10045 Piossasco (To) Italy.
Pursuant to Article 53 of Legislative Decree 206 of 2005, the customer has the possibility to withdraw from the contract / order stipulated on the Internet without any penalty and without the need to give any explanation, in compliance with the following conditions.
The right of withdrawal lapses:
For lack of the essential condition of integrity of the goods (packaging and/or its contents)
Even partial use of the goods and any consumables
The lack of the external packaging and/or the original internal packaging
The absence of integral elements of the product (accessories, cables, manuals, parts...)
Damage to the product for reasons other than its transport
For lack of the attached sales document (receipt)
In the cases indicated above, Simatshop sas will return the purchased goods to the sender, requesting the related shipping costs.
Customers who purchase with a VAT number and those who purchase customized goods cannot exercise the right of withdrawal.
In order to exercise this right of withdrawal, within a period of 14 (fourteen) working days from receipt of the products ordered, the customer must send the communication by email or fax, provided that it is confirmed by registered letter with return receipt within the following 48 hours. The material must be returned to:

The Communication must contain:
the expression of intent to avail of the benefit granted by Legislative Decree No. 206 of 2005
the indication of the product(s) for which you decide to avail yourself of the right of withdrawal
the data relating to your bank account (this is to allow the refund of the amount due).
To obtain a refund of the amount, the customer must, at his/her own expense, return the purchased products to the address that will be provided by email.
The return shipment must take place within fourteen working days of receiving the goods and can be made using a traceable method, with any carrier / courier / shipping agent the customer deems most appropriate.
Method of refunding the amount: SIMATSHOP will refund using the same payment method used during the purchase, in the shortest time possible, and in any case within 14 days of receiving the Communication.
The refund refers to the price of the returned product/s excluding shipping costs paid during the purchase.
It is expressly understood that the costs of returning the product to Simatshop will remain the responsibility of the customer.
Warranty: The products purchased from Simatshop are covered by a 24-month warranty as required by law. Products subject to wear are excluded, with the exception of phenomena clearly attributable to manufacturing and/or material defects. We inform you that if the products are found to be regularly functioning or have faults attributable to incorrect use, all transport costs will be borne by the buyer + a verification cost of €30
In the event of cancellation of the order by the customer, any costs due to payment transactions (credit card, paypal etc...) will not be refunded

With reference to the provisions of Legislative Decree 196/2003, containing provisions for the protection of confidentiality in the processing of personal data, we hereby wish to inform you that the personal data provided by you, or recorded and/or acquired in the context of our activity, may be processed with or without the aid of electronic means, in compliance with the aforementioned legislation, for the institutional purposes of our activity.
VAT rate at 10% for Photovoltaic Products
The final price includes VAT at 10i pursuant to Presidential Decree no. 633 of 26.10.1972, part III, table A, points 127-quinquies, 127-sexies for which the "solar kits/photovoltaic modules, photovoltaic accessories" purchased from the company Simatshop sas di Vaglio Antonella will be used exclusively for the installation of photovoltaic systems intended for the production of electricity.
WITHOUT SENDING THE VAT DECLARATION WE WILL NOT BE ABLE TO PROCESS THE ORDER
For different uses or for resellers, the VAT applied will be 22egrave; therefore the Customer must contact us before placing the order, in order to integrate the relevant quota.
The Customer undertakes to promptly communicate any eventual fact or circumstance, which causes the right to the above-mentioned relief to lapse, in order to allow you to issue the supplementary invoice for the difference in rate.
WEEE Eco-Contribution and CONAI
The prices indicated include the WEEE Eco-Contribution and CONAI where applicable.
Protection of personal data
All the data you provide us are to process your orders.
According to the law, you have the right to rectify, consult, modify and delete the data you have communicated to us from the SELLER. This right can also be exercised online.
